      È fatta salva la facoltà di avvalimento dei requisiti di capacità economica-finanziaria e di capacità tecnica — professionale ai sensi dell"art. 89 del D.Lgs. 50/2016 e di quanto indicato nel disciplinare di gara;

Il concorrente potrà ricorrere al subappalto solo se indicherà, in sede di offerta, le parti del servizio che intende subappaltare nonché la terna di subappaltatori.. Ai sensi dell"art. 95, c.12, D.Lgs. 50/2016, EAV Srl si riserva il diritto di non procedere all"aggiudicazione nel caso in cui nessuna offerta risulti conveniente o idonea in relazione all"oggetto dell"appalto; In ossequio all"accordo denominato «Protocollo di legalità», predisposto dalla Prefettura di Napoli, si provvederà a richiedere sul conto dell"impresa aggiudicataria l"informazione anti-mafia ex art. 10, D.P.R. n. 252/98.
